These Terms of Service ("Terms") govern your use of the MailboxApp mobile application and website (the "Service") operated by ARKA Investments LLC ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Description of Service
MailboxApp provides a virtual mailbox service that includes a physical mailing address, mail and package receiving, envelope and content scanning, mail forwarding, package consolidation, and mail disposal (shredding/recycling). The Service is accessed through our mobile application and is subject to subscription fees as described in the Pricing section of our website.
2. Eligibility
You must be at least 18 years old and a legal resident of the United States to use the Service. You must provide accurate, current, and complete information during registration and keep your account information updated.
3. USPS Form 1583 Requirement
Federal regulations (39 CFR § 111.2) require completion of USPS Form 1583 (Application for Delivery of Mail Through Agent) before we can receive mail on your behalf. You must complete and submit a notarized Form 1583 along with two forms of valid identification before mail processing can begin. We may reject or terminate your account if we are unable to verify your identity or if the Form 1583 is not completed within 30 days of account creation.
4. Account and Subscriptions
You are responsible for maintaining the confidentiality of your account credentials. Subscription plans are billed monthly in advance via credit or debit card through our payment processor, Stripe. Prices are listed in U.S. dollars and may be subject to change with 30 days' notice. You may upgrade, downgrade, or cancel your subscription at any time through the app. Cancellations take effect at the end of the current billing period.
5. Mail Handling
We will handle your mail in accordance with your instructions provided through the app. Specifically:
- Receiving: We accept letters and packages delivered to your assigned address by USPS, UPS, FedEx, DHL, and other major carriers.
- Scanning: We scan the exterior of envelopes upon arrival. Content scanning is available upon your request, subject to your plan limits.
- Forwarding: We forward mail and packages to addresses you specify. Shipping costs are charged separately and vary by carrier, destination, weight, and dimensions.
- Consolidation: You may request that multiple packages be combined into a single shipment to reduce forwarding costs.
- Disposal: You may request shredding or recycling of unwanted mail. Once disposed, mail cannot be recovered.
- Storage: We store mail for up to 30 days from the date of receipt at no additional charge. Mail stored beyond 30 days without action may be disposed of after written notice.
6. Prohibited Uses
You agree not to use the Service for:
- Any unlawful purpose or to receive illegal materials
- Fraud, identity theft, or deceptive business practices
- Receiving hazardous, perishable, or prohibited materials as defined by USPS and applicable shipping carriers
- Violating any applicable federal, state, or local law
We reserve the right to refuse or return any mail item we reasonably believe violates these Terms or poses a safety risk, and to terminate your account immediately if prohibited use is detected.
7. Fees and Payments
Subscription fees are charged monthly at the rate associated with your selected plan. Additional charges may apply for forwarding/shipping, content scanning beyond plan limits, and other premium services. All fees are non-refundable except where required by applicable law. Failed payments may result in service suspension until payment is resolved.
8. Limitation of Liability
To the maximum extent permitted by law, ARKA Investments LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid us in subscription fees during the 12 months preceding the claim. We are not responsible for loss or damage to mail or packages caused by shipping carriers, acts of nature, or circumstances beyond our reasonable control.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. While we strive to handle your mail with care, we do not guarantee uninterrupted service, error-free scanning, or specific delivery timeframes for forwarded mail.
10. Account Termination
You may cancel your account at any time through the app or by contacting us. Upon cancellation, we will hold any remaining mail for 15 days. After that period, unclaimed mail will be returned to sender where possible or securely destroyed. We may terminate your account immediately if you violate these Terms, fail to complete Form 1583, or engage in prohibited use.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
12. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes through the app or by email at least 30 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Knox County, Tennessee.
